Subject access request

You have the legal right to access personal information we hold about you. This is called a subject access request.

We do not hold social work files; these are held by the relevant local authority. If you wish a copy of your social work file, you should send your request directly to the relevant local authority.

Check whether you should make a subject access request to us

The Scottish Social Services Council (SSSC) is the regulator for the social work, social care and children and young people workforce in Scotland.

We protect the public by registering this workforce, setting standards for their practice, conduct, training and education and by supporting their professional development. Where people fall below the standards of practice and conduct we can investigate and take action.

Please read the guidance below on what we hold, and do not hold, carefully before you make a subject access request to us. In some cases, we may not be the right organisation to ask for your data.

Data we hold

We will hold personal data about you if:

  • you are, or have been in the past, registered with us
  • you have a current or previous Fitness to Practise investigation
  • you have a connection to a current or previous Fitness to Practise investigation.

Data we do not hold

We do not hold the following data:

  • social work/care records
  • social services case notes
  • adoption or fostering records.

More often than not this type of information is held by local authorities. We advise that you send your request to the relevant local authority directly. You can find a list of Scottish local authorities here.

Submitting a request

You can submit a request using our online form below.

We have one month from the date we receive your subject access request to provide you with a response. Asking for specific information will help us process your request sooner than if you ask for all your information. For example, you may only be looking for information between specific dates.

We need to be satisfied that you are who you say you are. This means that once we have received your subject access request we may ask you to provide evidence of your identity. We do this to protect your information, so that we can make sure that we’re providing a response to the right person.

If you would prefer, you can also submit a request via email or post. Please make sure you include the following information.

  • Full name
  • Date of birth
  • address, telephone number and email address
  • How you would prefer we contact you, ie email or post
  • Registration/application number if you have applied or are registered with us
  • Details of the specific information you require and any relevant dates.
