The Migration Advisory Committee (MAC) is consulting on the right of migrant workers (entering the UK via Tier 1 and 2 of the Points Based System) to settle in the UK. In this document the term "migrant workers" refers to workers from outwith the European Economic Area (EEA). Some social service workers in Scotland (particularly social workers working with children and families) enter the UK via the Tier 2 route. The consultation includes a proposal that Tier 2 would be redefined as temporary. This action would "end the assumption that settlement will be available for those who enter on this route". The right to settlement would be retained for some categories of Tier 2 workers such as those who are considered to be in occupations of "specific economic or social value to the UK".
The consultation paper is available from the MAC's website
Employers and other stakeholders are encouraged to contact MAC with their comments.
The consultation closes 31 August 2011.
